Welcome to DOT Lead Scout. By accessing our website, purchasing a subscription, or using our software services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, you may not access or use the Service.
DOT Lead Scout provides a SaaS (Software-as-a-Service) platform for medical examiners and healthcare providers. Our Service aggregates public data from the Federal Motor Carrier Safety Administration (FMCSA) and other sources to assist users in identifying and managing potential business leads for DOT physical examinations.
Eligibility: You must be 18 years or older to use this Service. The Service is intended for business use (B2B).
Account Security: You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account.
No Sharing: Accounts are for single-user or single-organization use. Sharing login credentials with individuals outside your organization is prohibited and may result in immediate termination.
Subscription Plans: We offer various subscription tiers (e.g., Scout and Engage). By selecting a paid tier, you agree to pay the fees indicated for that service.
Billing Cycle: Subscription fees are billed on a recurring monthly or annual basis via our third-party payment processor (Stripe).
Free Trials: If you sign up for a Free Trial, you will be automatically billed for the subscription rate on the day the trial ends unless you cancel prior to that date.
Cancellation: You may cancel your subscription at any time via the “Billing” section of your dashboard.
No Refunds: Payments are non-refundable. If you cancel in the middle of a billing cycle, you will retain access until the end of that cycle, but you will not receive a pro-rated refund.
Price Changes: We reserve the right to modify subscription fees at any time. We will provide you with reasonable prior notice of any price changes.
FMCSA Data (Public Data): A significant portion of the data displayed on our Service is sourced from public government records. We do not create this data, and we make no guarantees regarding its accuracy, timeliness, or completeness. We are not liable for any errors or omissions in the public data provided by the FMCSA.
Your Data: You retain ownership of any notes, appointment statuses, or custom lists you input into the CRM (“User Data”). You grant us a license to store and process this data solely to provide the Service to you.
Prohibited Use: You agree NOT to:
Use the Service for any illegal purpose.
Scrape, crawl, or mass-export data from the Service using automated scripts or bots.
Resell, sub-license, or redistribute the lead data found on our platform to third parties.
DOT Lead Scout provides tools to help you contact leads (e.g., Call Scripts, Email Integration, SMS). You are solely responsible for your compliance with all marketing laws.
Email: You agree to comply with the CAN-SPAM Act when emailing leads (e.g., providing an opt-out mechanism).
Phone/SMS: You agree to comply with the Telephone Consumer Protection Act (TCPA) and Do-Not-Call registries.
Indemnification: You agree to indemnify and hold DOT Lead Scout harmless from any fines, lawsuits, or damages resulting from your failure to comply with these marketing regulations.
We strive for 99.9% uptime, but we do not guarantee that the Service will be uninterrupted or error-free. We may temporarily suspend access for maintenance or upgrades. We are not liable for any business loss due to Service downtime.
Our Service integrates with third-party tools (Google Maps, Postmark, Telnyx). We do not control these services. If Google Maps changes their API or Telnyx experiences an outage, DOT Lead Scout is not liable for the resulting loss of functionality.
THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOT LEAD SCOUT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE DATA PROVIDED IS ACCURATE OR THAT LEADS WILL RESULT IN SALES.
IN NO EVENT SHALL DOT LEAD SCOUT, ITS OWNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING OUT OF YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in New York.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or a dashboard notification. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
